Assuming the contractual role in administering Design and Build Contracts

Pre-Tender Stage

  • Receiving client brief and agreeing requirements for the project in terms of design, specification, Egan compliance, timetable and so on
  • Instructing and liaising as required with other consultants and agents of the client
  • Preparing budget cost estimates for the scheme
  • Preparing the Employer’s Requirements and tender documentation
  • Inviting submissions from a select list of contractors, or negotiating with a single contractor
  • Examining the contractor’s proposals and tenders, and reporting on them to the client

Pre-Contract Stage

  • Liaising with the client’s solicitors to ensure the necessary consistency between the land contract and the construction contract
  • Negotiating and agreeing any outstanding price details with the successful tenderer
  • Checking further submissions from the tenderer, such as detailed design and specification proposals; negotiating and agreeing any amendments necessary to comply with the employer’s requirements
  • Finalising any outstanding contract terms and clauses, and completing the Form of Contract for signing by both parties
  • Finalising ‘Model Project Pacts’, or other partnering related documentation

Post-Contract Stage

  • Convening, chairing and minuting regular site meetings
  • Visiting the site to monitor the progress and construction of the works
  • Attending the site as necessary to ascertain and agree with the contractor the correctness of interim applications for payment
  • Preparing regular progress reports and cost reports and reconciliations for the client, as well as notices of payment recommendation
  • Collating for the client relevant Key Performance Indicator information
  • Issuing any necessary instructions, notices, etc, and ensuring that documentation to be issued to the contractor is received
  • Checking and agreeing with the contractor his valuation of any ‘changes’
  • Checking, negotiating and agreeing with the contractor any requests for extensions of time and/or loss and expense
  • Inspection of the works for the preparation of snagging lists (and subsequent re-inspection)
  • Checking and agreeing with the contractor the final account and final statement
